Chapter on Ibn Sayyad: Prophetic Interrogations and Examinations

Commentary on Hadith [2930]

۞

...in the presence of the Prophet [ﷺ] that Ibn Sayyad was the Dajjal): A group of scholars deduced from this the permissibility of swearing an oath based upon strong preponderance of probability (zann) and that absolute certainty is not a requisite condition therein. This is agreed upon among our fellow Shafi'i jurists; so much so that if a person sees in the handwriting of his deceased father that such-and-such amount is owed to him from Zayd, and it becomes predominant in his mind that it is his father's writing without being absolutely certain, it is permissible for him to swear an oath to claim his right.

[2930] His statement in the narration of Harmalah: (from Ibn Wahb from Yunus from Ibn Shihab from Salim from Ibn Umar that Umar departed...): This is how it appears across all manuscript copies. Al-Qadi mentioned that in the copy of Ibn Mahan, the mention of Ibn Umar was omitted, making the transmission appear broken (munqati') to him. He noted that this was unique to his copy, and the sound version is that of the majority, uninterrupted (muttasil) with the mention of Ibn Umar. His statement: 'at the utum of Banu Maghalah' (عند أطم بني مغالة): thus it is in some copies as 'Banu Maghalah' and in others as 'Ibn Maghalah', the former being the well-known vocalization. 'Maghalah' is with a fathah on the mim and a light ungeminated dotted ghayn. Muslim noted in the narration of al-Hasan al-Hulwani following this one that it was 'the utum of Banu Mu'awiyah' (with a dammah on the mim and an undotted 'ayn). The scholars said: the first reading is the famous, recognized one. Al-Qadi said: Banu Maghalah encompasses everything on your right when you stand at the end of al-Balat facing the Mosque of the Messenger of Allah (ﷺ). 'Al-Utum' (الأطم) is with a dammah on both the hamzah and the ta, meaning a fortress or fortified stone stronghold, its plural being 'atam'. His statement: 'fa-rafadahu' (he rejected/struck him): thus it occurs in most copies of our region with a dotted dad, and...
