Ibn Abd al-Barr favored the view that the souls of the martyrs are in Paradise, while the souls of others are in the courtyards of their graves, wandering wherever they wish.
It was narrated from Malik that he said: "It has reached me that the souls are set free, going wherever they wish."
It was narrated from Mujahid that he said: "The souls remain at the graves for seven days from the day the deceased is buried, not parting from it."
He and others substantiated their view with the hadith of Ibn Umar from the Prophet (ﷺ): "When any one of you dies, his seat is shown to him morning and evening: if he is among the people of Paradise, then from the people of Paradise; and if he is among the people of the Fire, it is said: 'This is your seat until the Day of Resurrection.'" This indicates that the souls are not inside Paradise, but rather it is only presented to them morning and evening; and this was similarly stated by Ibn Atiyyah and others.
However, there is no proof for them in this, for two reasons:
The first: It is possible that the presentation morning and evening is made to the soul connected to the body while the soul on its own is in Paradise, so the glad tidings and warning are conveyed to the body at these two times through the soul's connection with it, whereas the soul itself is perpetually in bliss or torment.
The second: That which is displayed morning and evening is the ultimate abode of the son of Adam in which he will permanently dwell in Paradise or the Fire, and the souls do not permanently settle in that final abode during the period of the Barzakh, even though they may already be in Paradise or the Fire.
For this reason, it was narrated in the hadith of al-Bara' ibn 'Azib from the Prophet (ﷺ): "When a door to Paradise is opened for the believer in his grave and it is said to him, 'This is your dwelling,' he says, 'My Lord, establish the Hour so that I may return to my family and my wealth.'"
As for offering salam (peace) to the dwellers of the graves, it does not prove that their souls reside permanently in the courtyards of their graves; for salam is conveyed at the graves of the Prophets and the martyrs while their souls are in the Highest 'Illiyyun. Nevertheless, they possess an instantaneous connection with the body, the true reality and manner of which is known to none except Allah, the Mighty and Majestic.
This is corroborated by the marfu' (attributed directly to the Prophet) and mawquf (halted at the Companions) narrations, including those from Abdullah ibn 'Amr.
